An assault charge can cover a wide range of actions from threatening someone in a manner that creates a reasonable apprehension of harm, to touching someone in a harmful or offensive manner, including more serious assaults involving weapons including knives and guns. Depending on the severity of the alleged assault, the facts may result in a charge that is a gross misdemeanor or felony. The most serious assaults are included under the Washington State three strikes law. If you've been arrested or charged with assault you need to speak with a criminal defense attorney as soon as possible.

  • A matter of degree: There are four degrees of assault charges. The most serious being first-degree assault. Both first and second-degree assault are felonies. They area also strike offenses under the three strikes law. Third-degree assault is also felony, but is not a strike offense. Fourth-degree assault is a gross misdemeanor. All are serious and will result in a criminal record, possible incarceration and fines. Call one of the attorneys at Stewart Beall MacNichols & Harmell, Inc., P.S., and we can explain the charges involved in your case including any potential penalties associated with the charge.
  • Investigation is essential: At Stewart Beall MacNichols & Harmell, Inc., P.S. we don't just accept the government's version of events. Our lawyers work to know more about your case than anyone working for the police or prosecution. If there are irregularities in the evidence, or if we believe that it was obtained improperly, we will challenge it and, whenever possible, have it excluded. This initial work places our clients in a more powerful position during plea negotiations, and gives us a stronger case should we need to go to trial. Ask Yourself: Who are the witnesses? Why did the police investigate the situation? Was there probable cause to stop, detain and/or arrest? The more our law firm knows about what happened, the better we can prepare your defense and protect your rights. Call us now to talk to a defense attorney about the circumstances and the factors that led up to the arrest for assault.
  • Assault with a weapon: You have seen the billboards: Hard Time for Armed Crime. If the police suspect you had a weapon, there will be a firearm enhancement to your sentence if you are convicted. Call one of the attorneys at Stewart Beall MacNichols & Harmell, Inc., P.S., and we can explain the impact of a weapons allegation including any potential enhanced penalties associated with penalties.
  • Three strikes: Obviously, if you are charged with a strike crime it is tremendously serious. You need to talk with an attorney as soon as possible. More significantly, if you have a strike against you , another strike will place you in serious jeopardy. The attorneys at Stewart Beall MacNichols & Harmell, Inc., P.S., will fully investigate the allegations against you. Where appropriate we may be able to challenge an earlier strike or, by challenging the strength of the prosecutor's evidence, obtain a plea offer to a charge that is a nonstrike offense.
